Terms and Conditions

Return Policy
NEW merchandise that is deemed by Zeros Ones to be defective may be
returned within 7 days at the
location of purchase, in accordance with
the rest of the terms outlined herein and below.
NEW merchandise that
is deemed by Zeros Ones to be non-defective will be charged a 15%
restocking fee.

SPECIAL ORDERS ARE NOT REFUNDABLE.
USED or refurbished merchandise is purchased on an “as is” and “with
all faults” basis. The entire risk as to
the quality and performance of
the merchandise is with the buyer. Should the merchandise prove
defective following purchase,
the buyer, and not the manufacturer, distributor, or retailer assumes
the cost of all necessary servicing or repairs.

Clearance or “as is”
merchandise may not be exchanged, returned, or receive a price
adjustment and is not covered by
any warranties for existing or future damages.
Cash purchases that are eligible for return will be refunded by check
that will be mailed approximately 2 weeks after return is made.

Warranty
Each unit is sold as-is with no warranty from Zeros Ones unless
otherwise written and agreed to. All sales are final unless
otherwise
noted. It is the user’s responsibility to fully test the functionality
of device before purchase. New products will be covered by the
manufacturer’s warranty.
PROBLEMS NOT COVERED UNDER WARRANTY: Computer limited warranties do not
cover some third party software-related problems.
Nor does the warranty
cover problems related to, or caused by, the installation of any
hardware item(s) after the
date of our original repair. Problems related to accident or service
performed by anyone other than an Zeros Ones technician.
We may
uninstall certain applications that are suspected to cause system
problems before we begin
troubleshooting. We are not responsible for any lost data although we
will make reasonable effort to safeguard your data. Hard drives can
fail at anytime.
When modifying your computer files and settings for
performance, some data will be erased including but not limiated to
cookies, history, start-up
entries
and other temporary files. We will not purposely erase your
important programs, bookmarks, favorites, email records, letters,
photos, videos and any other user-
created files. The possibility of such loss is always possible however;
please refer to our data policy to understand clearly your
responsibilities
regarding data backup prior to bringing your computer
in for service. When you request our services, you are acknowledging
that you have
read,
understand and agree to the computer repair terms and conditions
agreements on this page. Should it be determined in the course of the
performance of diagnostics
that the problems on your computer are hardware based, we will notify
you of required service on the hardware; diagnostic fees may still be
applicable.
An accurate estimate of the related repair expense cannot
be fully determined without
actually testing the hardware in some cases. Unless otherwise agreed,
we are not liable for and you agree to hold us harmless
from any and
all damages, costs, and expenses incurred as the result of any defect
or damage to any software,
hardware or data residing or recorded in your computer, whether
incurred during the course of our services or otherwise.
If service
involves transferring information or installing software, you represent
that you have the legal right to
copy the information, to use the software and agree to the terms of the
software license, and you authorize us to transfer the
information and
accept such terms on your behalf in performing the service. Warranty.
In servicing your
computer, we warrant that service will be performed in a professional
manner. All services are warranted for a period of 30 days.
There is no
warranty for removal of viruses, spyware, adware or malware if your
actions are the cause of
the repeated problem. You may be charged again for that service.
This warranty and remedy are exclusive and in lieu of all other
warranties, remedies, and conditions, whether oral or written,
express
or implied, with respect to any and all services performed for you by
us. We specifically disclaim any
and all implied warranties with respect to services and items,
including, without limitation, warranties of merchantability and
fitness
for a particular purpose, whether express or implied. If we
cannot lawfully disclaim implied
warranties under this limited warranty, all such warranties, including
warranties of merchantability and fitness for a particular purpose are
limited in
duration to the duration of the express limited warranty
only.

Data Policy
It is Customer responsibility to back-up the settings, software
(applications and user files) and other data that is stored on
Customers computers,
hard disk drive(s), and/or on any other storage
devices Customer may have, and Zeros Ones shall not be responsible at
any time for any loss, alteration, or
corruption of any software, data, or files. Zeros Ones shall not be
liable in any way for damages arising from any
part, equipment, peripheral, software
or other product supplied to
Customer by Zeros Ones. Notwithstanding any language to the contrary,
Zeros Ones maximum liability to Customer arising from or
related to Zeros Ones under this
Agreement shall be limited to the sums paid by Customer to Zeros Ones
under this Agreement during the 30 days prior to the time the cause of
action arose.
Customer bears the risk of data loss, and agrees that in the course of
computer repair and DATA RECOVERY services, data can be lost and the
condition
of the media is DETERIORATING CONSTANTLY. This means that
during attempts at recovery, further damage may occur and is not a
fault or through contribution of
efforts by Zeros Ones.

Emergency or expedited service
There will be an additional fee for service scheduled during non
business hours or outside of our regular availability, which would
require scheduling of additional resources or change of schedule to
other customers.

Special Orders
All special ordered parts must be paid for prior to ordering. Special
ordered parts must sometimes be ordered one at a time, and a single
order may not be comprehensive to repair your device(s).
THERE ARE
ABSOLUTELY NO RETURNS ACCEPTED

FOR SPECIAL ORDERED PARTS.
Free Estimate
We offer free verbal estimates for computers brought into one of our
retail locations. It is NON-BINDING and to be considered
a best-guess
by one of our associate. In no case will an estimate be treated as a
quote for service until a diagnostic is performed to confirm the
amount. Diagnostics are NOT FREE
OF CHARGE.

Diagnostic Fee
Although we offer a free verbal best-guess only ESTIMATE service, if
the computer needs to be hooked up to equipment or takes
longer than 5
minutes to diagnose, a minimum charge of $45 will be assessed and can
be applied towards the subsequent repair if performed as quoted by
Zeros Ones.

LCD and Digitizer Replacements for all devices
LCD screens and digitizers will be replaced with new or used parts
depending on availability. We will use original or compatible screens
of varying resolutions and of matte or gloss finish, based on
availability. If customer desires a specific or exact match for
replacement, they MUST REQUEST IT AT DROP
OFF TIME.
Any deviation from this process will lead to a full charge for the
original work performed and potential extra charges for changes or
re-work.
Computer, iPhone, iPod, iPad, and other mobile device repair
After diagnostic or repair, your device may not appear the same as when
it was brought to Zeros Ones. The nature of diagnosis and repair of
these devices is such that there may be further damage to the unit
during servicing (both physical and functional deterioration is
possible).
Due to the prior damage and current condition that the device has been
received by Zeros Ones for digitizer or LCD replacement, there may be
unseen or yet unmanifested additional damage to adjacent components and
parts such as LCD, bezel, battery, logic board, etc.
We cannot guarantee that our tools
will not leave behind scratches or other markings of replacement.
Optional repairs may be requested at additional cost for these part(s).
Due to the damage the item has sustained prior to our receipt and
repair, we can only warranty parts that we replace.
We CANNOT warrant
the complete functioning of repaired devices, as we only service and
replace certain components of your device, which could have sustained
other collateral damage.
Be sure to back up all data, as we are not accountable for lost data to
devices that are brought in for service.

Terms of Service
Unless stated in writing otherwise, all fees and charges are
nonrefundable. Zeros Ones may change the fees and charges then in
effect,
or add new fees or charges without notice. Zeros Ones accepts verbal
authorization to proceed with work and charge
for it accordingly.
Customer expressly agrees that use of products and
services is at customer’s sole risk. Services are provided on an “as
is” and “as available” basis.
Zeros Ones expressly disclaims all warranties of any kind,
whether express or implied, including, but not limited to the implied
warranties of merchantability, fitness for a particular
purpose and
non-infringement. Zeros Ones makes no warranty that the service will
meet customer’s requirements,
or that the service will be uninterrupted, timely, secure, or
error-free; nor does
Zeros Ones make any warranty as to the results
that may be obtained from the use of the service or as to the accuracy
or reliability of any information
obtained through the service.
Customer understands and agrees that any
material and/or data downloaded or otherwise obtained through Zeros
ONes is done at customer’s own
discretion and risk and that customer will be solely responsible for
any damage to customer’s computer/system or loss of data that results
from the download of such material and/or data.
No advice or information, whether oral or written, obtained by customer
from Zeros Ones shall create any warranty not expressly made herein.
Some jurisdictions do not allow the exclusion of certain warranties, so
some of the above exclusions may not apply to each customer.
It is the responsibility of customer to back-up all data on computers
and other devices; Zeros Ones will not be held liable for loss of any
customer data.
Abandonment and Failure to Pay in a timely manner Computers that are
not picked up within 30 days of work completion are
considered abandoned.
Abandoned computers will be disposed at the sole
discretion of Zeros Ones. Abandonment does not release the customer of
their duty to settle their bill.
Further, items may be sold or recycled in order to recover
unpaid fees after 30 days from the date that Zeros Ones communicated to
the
customer that their item(s) were ready for pickup. Notification may
come through media including but not limited to telephone call or
message, email, and
mailed letter.
Bills not paid within 30 days are delinquent are will have a late fee
added to them. The standard late fee is $50 per month, but can be
higher in some cases.

Customer Responsibility to Back-Up Data
Customer agrees that prior to Zeros Ones servicing any Customer
equipment it is Customer’s responsibility to:
(1) back-up the data, software, information or other files stored on
Customer’s computer disk drives, peripherals, MP3 player,
DVD player,
camcorder, digital camera and/or on any other electronic storage
device; and
(2) remove all videotapes, compact disks, floppy disks, laser disks,
cassettes, DVDs, film or other media from Customer’s product.
Customer agrees that whether or not Customer requests back-up services
from Zeros Ones and/or its third party service provider, neither Zeros
Ones
nor its third party service provider shall be liable under any
circumstances for any loss, disclosure, alteration or corruption of any
data, software,
information, files, videotapes, compact disks, floppy disks, laser
disks, cassettes, DVDs, film or other media.

Indemnification
Customer agrees to indemnify, defend, and hold harmless Zeros Ones (and
its affiliates and their respective officers, directors, employees and
agents)
from and against any and all losses, costs, obligations,
liabilities, damages, actions, suits, causes of action, claims,
demands, liens, encumbrances,
security interests, settlements, judgments, and other expenses,
(including but not limited to cost of defense, settlement, and
reasonable attorneys’ fees) of
whatever type or nature, including, but not limited to, damage or
destruction to property, injury (including death) to any person or
persons,
which are asserted against, incurred, imposed upon or suffered
by Zeros Ones by reason of, or arising from: (a) Customer’s breach of
this Agreement;
(b) Customer’s
actual or alleged infringement of any patent, copyright, trademark,
trade secret or other property or contract right of any other person;
(c) Customer’s actual or
alleged failure to promptly pay sums due Zeros Ones or third parties;
(d) Customer’s failure to comply with applicable laws,
regulations or
ordinances; or (e) the acts or omissions of Customer (or its officers,
directors, employees or agents).

Returned Checks
Returned checks will incur a $50 service charge as well as any other
actual fees incurred by Zeros Ones.
Virus Removal
There is no perfect tool to effectively and completely remove all
viruses/malware. Data loss is always a risk when attempting
to clean
the registry and file system. A complete operating system reinstall may
be required for some viruses.
As with any service that we offer, please make sure you have a backup
of your data before you allow us to start work.
Virus removal (or
eventual Operating System Reinstallation) procedures DO NOT INCLUDE
DATA BACKUP OR TRANSFER. Repeat
infections are NOT COVERED under our 30 day labor warranty.
Recovery after a serious virus or malware infection is often difficult
to achieve and Zeros Ones cannot guarantee that all of your software,
documents or photographs etc. can be preserved. Your computer will
usually be returned in a condition which will allow the reloading of
your favorite software
and
a trouble-free operating system.
PLEASE NOTE: If your PC has become severely infected we may need to
re-install Windows, as re-installation may be the
only way to be 100%
sure that the virus, malware, or rootkit has been removed.
Antivirus Programs and other software
Zeros Ones associates may make personal recommendations of software
including Antivirus, but advice is never
to be interpreted as a
guarantee of performance. Recommendations are to be considered as
nothing more than accounts of personal experience.
THERE IS NO PERFECT OR ALL ENCOMPASSING Antivirus software, and
regardless of the software you use, there is a chance of infection.

Equipment SOLD or DONATED to Zeros Ones
There is no guarantee of data destruction for sold or donated PC’s to
Zeros Ones.
For computers purchased from customer, expect at least 2 weeks to
receive payment by check via postal mail.
If you would prefer to pickup
a check from one of our retail locations, please ask your associate to
note it and reasonable
efforts will be made to accommodate your request. Tax forms will be
sent to you in accordance with IRS and other government guidelines.
Extended Service Plan If available, an extended service plan may be
offered to you separately
by an associate and full terms disclosed in written form, which
supercede any verbal communications.
Special Offers, Coupons and Promotions
Only one form of discount or special offer can be used per customer
(household or business) per work order generated. Offers cannot be
combined or stacked.
Privacy Policy
We collect information from you when you place an order or subscribe to
our newsletter. When ordering or registering, you may be
asked to enter
your: name, e-mail address, mailing address, phone number or other
information. Any of the information we collect from you may be used in
one of the following
ways:
To personalize your experience: (your information helps us to better
respond to your individual needs); To improve our website (we
continually strive to
improve our website offerings based on the
information and feedback we receive from you)
To improve customer service: (your information helps us to more
effectively respond to your customer service requests and support needs)
To process transactions: Your information, whether public or private,
will not be sold, exchanged, transferred, or given to any other company
for
any reason whatsoever, without your consent, other than for the
express purpose of
delivering the purchased product or service requested: To administer a
contest, promotion, survey or other site feature
To send periodic emails: The email address you provide for order
processing, may be used to send you information and updates pertaining
to your order, in addition to receiving occasional company news,
updates, related product or service information, etc.
We do not sell, trade, or otherwise transfer to outside parties your
personally identifiable information. This does not include trusted
third parties
who assist us in operating our website, conducting our
business, or servicing you, so
long as those parties agree to keep this information confidential. We
may also release your information when we believe release is
appropriate to comply
with the law, enforce our site policies, or
protect ours or others rights, property, or safety. However,
non-personally identifiable visitor information may
be
provided to other parties for marketing, advertising, or other uses.
Occasionally, at our discretion, we may include or offer third party
products or services on our website. These third party sites have
separate and independent privacy policies. We therefore have no
responsibility or liability for the content and activities of these
linked sites.
Nonetheless, we seek to
protect the integrity of our site and welcome any feedback about these
sites.
